VACATION CONTRACT

Your vacation contract
We are the sales agent for the Club Med vacation wich you have booked (the "Vacation"). We do not own, manage, control or operate any transportation vehicle, hotel, Club Med resort, cruise ship, restaurant or other supplier of services. Your Vacation is provided by Club Med, Inc., Club Méditerranée S.A. or certain of its subsidiaries or affiliates, in the case of a Club Med Vacation (the "Operators").


Cancellations
Club Med Sales Inc. will not cancel a flight less than 10 days before the scheduled departure date, except for circumstances that make it fisically impossible to perform the charter trip. Your right to a refund it you cancel your Club Med Land/Cruise only, or Land/Cruise with Air package,is limited as set for here. If you wish to cancel or revise a reservation (a revision being any change whatsoever in the reservation as booked), the following charges (percentage of the total package price), plus the non-refundable membership fee, will be assessed after payment of any amount:

Please note: Revisions of any kind, such as a change of departure date or village/ship, will be treated as cancellations and governed by the terms and conditions of cancellations procedures. Unpaid balances on cancellation fees are subject to collection action.

Substitutions may be accepted, except during holiday periods, and are subject to a $25 fee and any applicable airline ticketing fee and/or ticketing restriction.


Travel & Reservations

Rates
All rates are per person, double occupancy, in U.S. dollars and exclude membership/initiation fees. Nightly, Weekly and Cruise rates do not include air transportation or transfers; Departure City and Zone City rates do not include air transportation or transfers. All rates are subject to Club Med's Vacation Contract (Terms and Conditions) in this insert and/or those made available to you with your documents and apply only to sales made through Club Med Sales, Inc. in the U.S. Land, air and/or sea rates, departur dates, programs and itineraries are subject to change at any time prior to departure and without notice, whether or not you have paid for you vacation in full or in part. Air rates on scheduled service are subject to limited availability and certain restriction; all routes are subject to change without notice. Land price subtracted from the package price does not necessarily reflect the true air cost. Children's age and rate are determined at time of travel, not time of reservation. Check-out time varies from village to village, please inquire. Children under 6 will be lodged in the same room as their parents. During school holidays periods, a greater number of families with children may be present in all villages, excluding Cancun, Playa Blanca and Turkoise. Member arranging their own transportation should arrive at the villege between 9:00 a.m. and 7:00 p.m.; for Copper Mountain and Sandpiper, please inquire; ship departures vary by itinerary.


Membership Fees
As a member of Club Med, you'll receive travel insurance coverage, periodic members-only vacation savings offers and informative mailings throughout the year. Fees are automatically charged when you pay for your vacation.
Annual Membership provides Club Med membership effective for one year, commencing on date of deposit; it must be paid when a member travels subsequent to the anniversary date of initial Annual Membership, regardless of when corresponding reservation was bookd. Fees are per person and are non-refundable.


Payment
We require full payment when booking is made within 45 days of departure.


Deposit
A deposit of 25% per person, plus membership/initiation fee, is required. Current membership number should be indicated, if applicable. An invoice voucher plus membership cards, a booklet containing "Healthful & Helpful Hints" and the Holiday Insurance Plan will be sent upon receipt of deposit.


Final Documents/Final Payment
Final payment is required 45 days before departure. Final documents are issued only upon receipt of final payment. Delivery of documents is not guaranteed if final payment is not received on time.
For zone bookings reserved and/or paid within 30 days of departure, a $10 handling fee will be charged to send airline tickets via Express Mail. For all other bookings, final travel documents canbe sent by Express Mail at your request for a $10 handling fee.
Booking will be cancelled with penalties if payment is not received by specified date. Also, you will be charged an administrative fee for a returned check or for a change in the form of payment.
Please note: Club Med does not fax invoices in lieu of final documents.

Once a booking has been made, it is assigned a confirmation number. A 25% deposit is required (and membership/initiation fee) showing this confirmation, plus the guest's full name and address, must be received no later than the date specified at time of booking, in order to avoid automatic cancellation.

Applicable only to current members who have booked and paid for the trip and membership fees in the U.S. This coverage supersedes any previously issued coverage and is subject to change without notice.


Q. What will be reimbursed if I have to cancel my trip before departure?
A. If canceled for a covered reason, each member, as defined, will be reimbursed actual cancellation fees assessed by Club Med or $3,000, whichever is less for the non-refundable portion of air, land & sea travel arrangements, subject to a $100 deductible if cancelled within 8 days of departure. For more information, please review the Trip Cancellation/Interruption Benefits and Exclusions as described on pg.19 and 24.


Q. What are the covered reasons?
A. Injury, sickness, or death or other unforeseeable circumstance (on page 22-23) of the Insured Person, a member of their immediate family, an unrelated traveling companion or a business partner (as defined on pg.
22-23).


Q. Is there a deductible to trip cancellation?
A. Yes. However, the $100 deductible applies per member only if the trip is cancelled within 8 days of departure.


Q. What must I do if I have a claim?
A. Notify the appropriate Club Med representatives (if you are interrupting your trip, contact the Village Ticket Office; for all other claims contact the Village Gestionnaire), follow the Claims Procedure outlined on pg.25 of this brochure, and contact Triad Professional Adjusters to obtain a Claim Form.

Description of Coverages

Who is eligible for coverage
A person who is a current Club Med member and has booked and paid for the trip and membership fees in the U.S.


When coverage begins
The Trip Cancellation/Interruption Benefit will be effective on the date your deposit for your Trip is received by Club Med.

All other coverages will begin on the later of:
(1) the date and time you start your Trip; or
(2) the Scheduled Departure Date of your Trip.

When coverage ends
All coverage ends on the earlier of:
(1) the date the Trip is completed;
(2) the Scheduled Return Date;
(3) your arrival at the return destination on a round trip, or the destination on a one-way trip;
(4) cancellation of the Trip covered by the policy.

Termination of the policy will not affect a claim for loss which occurs after premium has been paid.

All coverage under the policy will be extended if your entire Trip is covered by the policy and your return is delayed by unavoidable circumstances beyond your control.

If coverage is extended for the above reasons, coverage will end on the earlier of the date you reach your originally scheduled return destination or seven (7) days after the Scheduled Return Date.


Summary of Coverage

We will pay this benefit up to the amount listed below if you are injured in an accident which occurs while you are on a Trip and covered under the policy, and you suffer one of the losses listed below within 365 days of the accident:

If you suffer more than one loss from an accident, we will pay only for the loss with the larger benefit. Loss of a hand or foot means complete severance a t or above the wrist or ankle joint. Loss of sight of any eye means complete and irrecoverable loss of sight.


Definitions

"Baggage" means luggage and personal possessions taken by you on the Trip.

"Business Partner" means an individual who is involved with you in a legal partnership and shares in the management of the business.

"Covered Death" means your death or the death of an Immediate Family Member, Traveling Companion or Business Partner which is the direct result of a Sickness or Injury as defined in this Policy.

"Hospital" means an institution which meets all of the following requirements:
(1) it must be operated according to law;
(2) it must give 24-hour medical care, diagnosis and treatment to the sick
or injured on an inpatient basis for which a charge is made;
(3) it must provide diagnostic and surgical facilities supervised by Physicians;
(4) registered nurses must be on 24-hour call or duty;
(5) the care must be given either on the hospitalis premises or in facilities available to the hospital on a pre-arranged basis.
A Hospital is not: a rest, convalescent, extended care, rehabilitation, or other nursing facility; a facility which primarily treats mental illness, alcoholism, or drug addiction (or any ward, wing or other section of the hospital used for such purposes); or a facility which provides hospice care (or wing, ward or other section of a hospital used for such purposes).

"Immediate Family Member" means your or your Traveling Companion's spouse, child spouse's child, daughter-in-law, son-in-law, brother, sister, mother, father, grandparents, grandchild, step-brother, step-sister, step-parents, parents-in-law, brother-in-law, sister-in-law, aunt uncle, niece, nephew, guardian, or ward.

"Injury" means bodily injury caused by an accident occurring while your coverage is in force under this Policy. The Injury must be direct cause of loss and must be independent of all other causes and must not be caused by, or result from, Sickness.

"Insured" means an Eligible Person who takes a Trip, completes any required enrollment form, and pays any required premium. The words "you", "your", or "yours" mean the Insured.

"Other Valid and Collectible Group Insurance" means any group policy or contract which provides for payment of medical expenses incurred because of Physician, nurse, dental or Hospital care or treatment; or the performance of surgery or administration of anesthesia. The policy or contract providing such benefits includes group or blanket insurance policies; service plan contracts; employee benefit plans; or any plan arranged through an employer, labor union, employee benefit association or trustee; or any group plan created or administered by the federal or a state government or its agencies. In the event any other group plan provides for benefits in the form of services in lieu of monetary payment, the Usual an Customary value of each service rendered will be considered a Covered Expense.

"Physician" means a person licensed by the jurisdiction in which he is resident to practice the healing arts. He must be acting within the scope of his license and may not be you or your parent, spose, child or sibling.

"Pre-Existing Condition" means an illness, disease, or other condition during the 90 day period immediately prior to your effective date for which you or your Traveling Companion or Immediate Family Member booked to travel with you:
1. Received, or received a recommendation for, a diagnostic test, examination, or medical treatment; or
2. Took or reseived a prescription for drugs or medicine.
Item (2) of this definition does not apply to a condition which is treated or controlled solely through the taking of prescription drugs or medicine and remains treated or controlled without any adjustment or change in the required prescription throughout the 90 day period before coverage is effective under this Policy.

"Scheduled Departure Date" means the date on which you are originally scheduled to leave on your Trip.

"Scheduled Return Date" means the date on which you are originally scheduled to return to the point where the Trip started or to a different final destination.

"Sickness" means an illness or disease of the body which:
1) requires treatment by a Physician, and
2) commences while this insurance is in force. An illness or disease of the body which first manifests itself and then worsens or becomes acute prior to the effective date of this insurance is not a Sickness as defined herein and is not covered by this Policy.

"Traveling Companion" means a person whose name appears with yours on the same Trip arrangement and who, during the Trip, will share accomodations with you in the same room, cabin, condominium unit, apartment unit, or other lodging.

"Trip" means a scheduled trip to a Club Med facility for which all travel arrangements are provided by Club Med prior to the Scheduled Departure Date of the Trip.
Air travel arrangements not provided by Club Med are not considered a part of a Trip, as defined, and are NOT covered by this Policy.

"Unforeseen Circumstance" means only the following events or their consequences:
(1) air carrier delays resulting from organized labor strikes that affect public transportation;
(2) arrangements canceled by an airline resulting from inclement weather or organized labor stikes that affect public transportation;
(3) a change in plans by you, an Immediate Family Member traveling with you, or Traveling Companion resulting from one of the following events which occurs while coverage is in force under this Policy:
(a) being directly involved in a documented traffic accident while en route to departure;
(b) being hijacked, quarantined, required to serve on a jury, or subpoenaed as a witness in a court proceeding;
(c) having a residence made uninhabitable by fire, flood, volcano, earthquake, hurricane or other natural disaster;
(d) being called into active military service to provide aid or relief in the event of a natural disaster;
(e) a documented theft of passports or visas;
(f) a transfer of employment of 250 miles or more.

"Usual and Customary" means the usual charge made by a provider for necessary medical services, treatment or supplies. It may not exceed the general level of charges for similar necessary services, treatment or supplies made by other providers in the area where the service or treatment is given or the supply bought.


Policy Exclusions

The following exclusion applies to Coverage 1 (Accidental Death and Dismemberment):

1. We will not pay for loss caused by or resulting from sickness of any kind.

The following exclusion applies to Coverage 2 and 3 (Injury and Sickness Medical Expense and Trip Cancellation/Interruption):

2. We will not pay for loss or expense incurred as the result of a Pre-Existing Condition, as defined, including death that results therefrom.

The following exclusions apply to all Coverages:

3. This Policy does not cover loss caused by:
a. suicide, attempted suicide, or intentionally self-inflicted injury of you, a Traveling Companion, Immediate Family Member, or Business Partner booked to travel with you, while sane or insane;
b. mental, nervous or psychological disorders;
c. being under the influence of drugs or intoxicants unless prescribed by a Physician;
d.normal pregnancy or resulting childbirth;
e. participation in organized athletic activities other than those sponsored by Club Med;
f. mountain climbing or bungee cord jumping;
g. riding or driving in any motor competition;
h. declared or undeclared war, or any act of war;
i. civil desorder;
j. service in the armed forces of any country;
k. nuclear reaction, radiation or radioactive contamination;
l. operating or learning to operate any aircraft, as pilot or crew;
m. parachuting, hang gliding, parasailing or travel on any air supported device, other than on a regularly scheduled airline or air charter company;
n. any unlawful acts, committed by you or a Traveling Companion
o. any amount paid or payable under any Worker's Compensation, Disability Benefit or similar law;
p. loss or damage caused by detention, confiscation or destruction by customs;
q. a loss that results from an illness, disease, or other condition, event or circumstance which occurs at a time when this Policy is not in force for you.


Claims Procedure

Trip Cancellation/Interruption Claims: If you must cancel your trip before the scheduled departure, contact Club Holidays All Inclusive at 1-877-582-2284 to advise of your cancellation. You must also notify Triad Professional Adjusters, LLC in writing within 30 days, or as soon after that as is reasonably possible. A Claim Form will be sent to you, which must be completed by you and the attending physician.

If you must interrupt your trip, contact the Village Traffic Office who will arrange reservations for your flight back. You must also notify Triad Professional Adjusters, LLC in writing within 30 days, or as soon after that as is reasonably possible.
